What is an HUF?

A Hindu Undivided Family (HUF) consists of all descendants of a common male ancestor, including their wives and unmarried daughters. While the term isn’t defined in income tax law, it finds its roots in Hindu Law as a family entity.
An HUF persists even after the death of the common ancestor, with the next eldest male member assuming the role of the “Karta” or head of the family, acting as the family’s manager. Remarkably, the HUF continues to exist even if all male members pass away. Defined by Hindu Law, an HUF cannot be created through an agreement between two parties or by a group of unrelated individuals. It’s a unique entity, not limited to Hindus alone, as Buddhists, Jains, and Sikhs can also form an HUF.

    One of the major benefits of forming a Hindu Undivided Family (HUF) is that it is recognized as a separate legal entity. This allows the HUF to obtain a separate PAN card and open bank accounts in the name of the HUF.

    An HUF can receive monetary gifts up to INR 50,000 in cash, cheque, or draft without being subject to income tax. Additionally, gifts given by the Karta to his daughter on her marriage are exempt from taxation.

    Creating an HUF is straightforward and requires a HUF Deed, a formal legal document on stamp paper that lists the names of the Karta and the co-parceners (other members).

    Forming an HUF provides an additional PAN card, which can be used to take advantage of tax benefits. The family can file taxes individually using the new PAN card issued in the name of the HUF.

    Each member of an HUF has equal rights to the property owned by the HUF. New members added through birth or marriage also share equally in the property. Even an unborn child in the mother's womb has equal rights.

    Inheritance can be accepted in the name of the HUF. Legal heirs have a vested interest in the legacy, and after the person who made the will passes away, his children are also considered legal heirs to the inherited property.
