What is Trademark Objection?

Trademark Objection

Once a trademark application is filed, the Trade Marks Registrar will process it and issue an Examination Report. This report could either approve your trademark for advertisement before registration or raise an objection against its registration. The reasons for objections can vary and are not fixed.

The Trade Marks Office may object to your trademark application for various reasons, such as the word or logo being too similar to an existing trademark. The law allows you to respond professionally to these objections. You must file your response within a month of the Examination Report being published online. If you fail to respond within this timeframe, the Registrar may abandon your application.

What is Trademark examination Report?

A trademark examination report is issued by the Trademark Office after assessing the registrability of an application. This examination includes evaluating distinctiveness, checking for similarities with prior registrations, and reviewing supporting documents.

A professionally drafted objection reply can strengthen your case by providing valid reasons why your application should proceed. If the Trademark Examiner finds your reply satisfactory and addresses all the queries raised in the Examination Report, the application will be allowed to be published in the Trademark Journal, bringing you closer to using the ® mark.

Effectively Replying to Trademark Objections

Points to make your decision easy

By the time you receive an objection, you might already be using the ™ symbol. Your business brand would have started gaining visibility and creating value. Instead of filing a new trademark application, it is more relevant to identify the reasons why your logo, slogan, or brand name is distinct.

Filing a reply to an objection does not guarantee that your application will be sustained. However, it is essential because you wouldn't want your application to be abandoned for a few reasons. Expert professionals like those at My File Tax can be invaluable during this time. Drafting and filing an objection reply through us will significantly improve your chances of success.

Once an examination report is issued, you have one month (30 days) to file your reply. While you can file a reply even after 30 days, doing so significantly reduces your chances of advancing your trademark application. Therefore, it is advisable to respond promptly and ensure the submission of your objection reply within the defined time frame.
